Pregnant Woman Who Was Shot Charged for Baby’s Death — Shooter Goes Free

An Alabama woman is being charged in her unborn baby’s death — after someone else shot her in the stomach.

(TMU) — An Alabama woman whose unborn child was killed in a shooting has been indicted for the death despite not firing the weapon.

Marshae Jones, 27, was indicted by a grand jury on a manslaughter charge and taken into custody on Wednesday, according to AL.com. Police claim she initiated the conflict which lead to the gunfire.

The shooter, 23-year-old Ebony Jemison, was initially charged with manslaughter but the charge was dismissed after a grand jury failed to indict her.

Jones, who was five months pregnant at the time of the incident, was shot in the stomach by Jemison outside of a Dollar General in Pleasant Grove—a suburb of Birmingham—on December 4, 2018. The unborn child did not survive the shooting.

Authorities say their investigation revealed Jones was the aggressor and initiated the fight, which lead to Jemison being forced to defend herself.

“The investigation showed that the only true victim in this was the unborn baby,’’ Pleasant Grove Police Lt. Danny Reid said. “It was the mother of the child who initiated and continued the fight which resulted in the death of her own unborn baby.”

“Let’s not lose sight that the unborn baby is the victim here,’’ Lt. Reid continued. “She had no choice in being brought unnecessarily into a fight where she was relying on her mother for protection.”

Police say the dispute started over the father of the unborn baby.

Jones is currently being held on $50,000 bond.
